terms of service

These Terms of Service (the "Terms") govern your access to and use of the tissue.systems platform, websites, APIs, and command-line tools (together, the "Service"), operated by Tissue Systems, Inc., a Delaware corporation ("Tissue", "we", "us"). By creating an account or using the Service, you agree to these Terms.

01 Accounts

You must provide accurate information when creating an account and are responsible for all activity that occurs under it, including activity by any API tokens you issue. Keep your credentials and tokens secret; notify us promptly at security@tissue.systems if you believe they have been compromised. We may refuse or revoke access at our discretion.

An account can have more than one person on it. Each person holds a role — owner, admin, or member — that bounds what they can do, and an owner or admin can invite someone, change their role, or remove them. Inviting someone gives them access to the account's content within their role, and the account remains responsible for what they do with it. Removing someone ends their sessions and deletes the API tokens they issued on the account.

02 Acceptable use

You agree not to use the Service to:

• violate any law, or infringe the intellectual-property or privacy rights of others;
• send spam, host malware, or run phishing or other fraudulent operations;
• mine cryptocurrency, or run workloads whose primary purpose is to consume compute rather than serve your application;
• attack, probe, or attempt to gain unauthorized access to the Service, its infrastructure, or other users' Cells and data;
• knowingly deploy code that disrupts, degrades, or overloads the platform.

We may suspend Cells or accounts that threaten the stability, security, or lawful operation of the Service.

03 Your content

You retain all rights to the code, data, and other content you deploy or store on the Service ("Your Content"). You grant us the limited licence needed to host, execute, transmit, and back up Your Content solely to operate and provide the Service. You are responsible for having the rights necessary to use Your Content and for ensuring it complies with these Terms.

04 Service availability

The Service is provided on an "as is" and "as available" basis, and we do not offer an uptime guarantee. Features and limits may change; where a change removes something a paid plan included, we will give notice before it applies to your renewal. If we discontinue the Service or a paid plan, we will give notice and refund the unused part of any period you have already paid for. We publish current operational status at tissue.systems/status.

05 Fees

Tissue offers a free plan and paid plans; current prices and limits are listed on Pricing. Paid plans are billed in advance through Stripe, monthly or annually as you choose, and renew until you cancel. Prices are exclusive of tax; sales tax is added at checkout where we are registered to collect it. Cancelling stops the next renewal, and the plan keeps serving until the period you have paid for ends; part-periods are not refunded, with one exception: an annual term is refunded pro rata if you ask within 30 days of the charge. We will give notice before a price change applies to your renewal.

If a payment fails we email you and retry the card. If it is still failing after 14 days we pause the parts of Mast that do work on your behalf: escalation to other people, and probes. We never pause the pager itself; a page sent to a channel you own still reaches your phone. Paid platform features may be suspended after the same 14 days. If you move to a plan whose cap you are already over (more people, channels, vitals or probes than the plan allows), we delete nothing: what you already have keeps working, nothing more can be added until you are under the cap, members beyond the plan's headcount become read-only and can still be paged, and the account owner is paged to say so. Removing the excess or moving back up lifts all of it.

06 Termination

You may stop using the Service at any time. An owner can close an account from the dashboard; closing schedules it for deletion after seven days, during which the account keeps serving and any owner can cancel. When that period ends we delete the account and its content, as described in section 05 of the Privacy Policy. We may suspend or terminate your access if you materially breach these Terms or if required to protect the Service or other users. On termination, Your Content may be deleted; export anything you wish to keep beforehand from the dashboard, the ribo CLI, or the API.

07 Mast

Mast is our paging product: the Mast Pager app for iPhone, the channels and keys you use to send it pages, and the monitoring features that go with them. The app is sold and installed through Apple's App Store under Apple's terms, and it runs on iPhone only. The channels, keys and history behind it are part of the Service and are covered by these Terms.

A page is delivered through Apple's push service to the phone you registered. We hand every page to Apple as soon as we accept it, but delivery from there depends on Apple, on the phone's network and on the phone's own settings, so delivery is best effort. Do not rely on Mast as your only way of learning about something that could hurt a person or destroy property.

Unless the plan you are on lists an uptime commitment on Pricing, section 04 applies to Mast as it does to the rest of the Service: no uptime guarantee and no credits. Where a plan does list a commitment, the credit it describes is the only remedy for missing it.

A channel key lets anyone who holds it page your phone. Keep keys out of public code and screenshots, rotate a key you think has leaked, and tell us at security@tissue.systems if you believe a key was used to send you pages you did not expect. Page history and the beat history behind vitals are kept for the period stated in section 05 of the Privacy Policy, and closing your account deletes them along with everything else.

If we ever discontinue Mast, we will email every account owner at least 90 days before it stops. For that whole period you can export your channels, keys, vitals, schedules and history in the channels-as-code format, which is the same file the reconcile script reads, so what you take out can be put into whatever you move to. We refund the unused part of any annual term without being asked.

08 Data processing

Where the content you deploy or the pages you send include personal data about other people, you are the controller of that data and we process it on your instructions to run the Service, as described in the Privacy Policy. On Colony, on Sovereign and on the top Mast plan we will sign our standard data processing agreement on request, including the list of sub-processors in section 03 of the Privacy Policy; email privacy@tissue.systems. We do not sign customer-supplied agreements, and the other plans are covered by the Privacy Policy alone.

09 Disclaimers & liability

To the maximum extent permitted by law, Tissue disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Tissue will not be liable for indirect, incidental, or consequential damages, or for lost profits or data, arising out of your use of the Service.

10 Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
